The Macrobond products and services may include data, information, software or other services provided by third parties. Some third-party providers require Macrobond to pass additional terms through to Customers with respect to access and use of the third party’s providers Data and/or software. These third-party provider terms are subject to change at the provider’s discretion and new third-party providers may be added from time to time.
Please find below the current third-party provider terms for the Macrobond products and services. Customers use of the Macrobond products and services constitutes Customer’s agreement to be bound by these third-party terms, which are incorporated into the Agreement.
Capitalized terms used herein but not defined shall have the meanings set forth in the Agreement between Macrobond and Customer.
Data Provider Terms and Conditions
American Bankers Association
Customer shall attribute the Data with the following:

Credit Suisse Tremont
The Data is made available to Customer for Customers own internal use and may not be reproduced or disseminated in any form, nor may it be used to create, offer or sell any security, financial instrument or index.
CME Group
Customer must not redistribute Data outside of Customer’s Group, provided that Customer may distribute limited extracts of Data on an occasional basis to its client’s subject to Information Policies, provided that such information:
(a) consists of one value per tenor per instrument with no other depth of book;
(b) is provided manually; and
(c) is provided on a push basis only.
CME may determine in its sole discretion whether any distribution meets the requirements of this provision.
Economist Intelligence Unit (EIU)
Permitted Uses. Customer may display the Data on the screen of a terminal and print one copy of such Data for its non-commercial use. Customer may also print or download reasonable portions of the Data for use in carrying out its own business management and decision-making purposes. Customer may, on an occasional and irregular basis, provide insubstantial portions of the Data in memoranda, reports and presentations provided that these insubstantial portions are only made available in print or by secure electronic means to a limited number of individuals within Customer’s organization.
FactSet
Data extracted via the Product is licensed solely for the extraction of data in support of the workflows of individuals who are licensed to access and extract the relevant data on FactSet (“Authorised FactSet Users”) (i.e., use of an Insubstantial Amount of the FactSet Data in view-only format via reports, presentations, and data visualization tools). For the avoidance of doubt, Data may not be shared with individuals who are not Authorised FactSet Users. Redistribution of FactSet Data (i.e., distribution to downstream applications, databases, data warehouses, internal/external portals, etc.) extracted via the Product will require a separate Order Form and may be subject to additional fees.

Redistribution Restrictions: Customer’s use of the Data shall be subject to the following:
(a) Designated User may only use or access Data in the Product.
(b) Data may only be displayed in the Product as view-only.
(c) Designated User(s) may only download an Insubstantial Amount of the Data from the Product in the form of charts. “Insubstantial Amount of the Data” means an amount of the Data that (i) has no independent commercial value as a database, (ii) could not be used as a substitute for the Data or any part of it, (iii) is not separately marketed by the Designated User(s) or Customer at which the Designated User works, an affiliate of the Customer at which the Designated User(s) works or a third-party source, and (iv) is not regularly or systematically retrieved in a manner that does not satisfy clauses (i), (ii) and (iii) of this definition.
(d) Macrobond shall restrict the downloading ability of each Designated User(s) or Customer to an Insubstantial Amount of the Data.
(e) Customer’s and Designated User(s) downloading abilities shall be limited as follows:
(i) Up to 10 requests per second, and
(ii) Up to 1,000 unique securities (aggregated monthly).
Derived Data Permissions and Restrictions: Customer and Designated User(s) is not permitted to create Derived Data using the Data.
FactSet API terms and conditions.
User and Redistribution Restrictions: Customer’s and Designated User(s) use of the Data shall be subject to the following:
(a) Designated User(s) may only use or access Data via the Product.
(b) Designated User(s) may only download an Insubstantial Amount of the Data from the Product related to or adjacent to the creation of charts. “Insubstantial Amount of the Data” means an amount of the Data that (i) has no independent commercial value as a database, (ii) could not be used as a substitute for the Data or any part of it, (iii) is not separately marketed by the Designated User(s) or Customer at which the Designated User(s) works, an affiliate of the Customer at which the Designated User(s) works or a third-party source, and (iv) is not regularly or systematically retrieved in a manner that does not satisfy clauses (i), (ii) and (iii) of this definition.
(c) Should an individual Designated User wish to download more than an Insubstantial Amount of the Data, a Data Feed subscription would be required with Factset.
(d) Data may not be used in any production process or automated process by Designated User(s) or Customer, including API or refreshable excel links.
(e) Customer and Designated User(s) downloading abilities shall be limited as follows:
(i) Up to 10 requests per second, and
(ii) Up to 1,000 unique securities (aggregated monthly).
(f) For the purposes of paragraph (e) above, each unique security is equal to the number of identifiers included in a request, regardless of how many formulas are included in the request. For example, if a group of securities is requested via a unique identifier e.g. a benchmark such as the S&P 500 with index level information via a FactSet Market Aggregate formula, this will count as 1 (one) unique identifier and, consequentially, 1 (one) unique API point even if the formula requires the underlying constituents behind the scenes to generate index level data.
(g) The following entity types are permitted to be Designated User(s): (i) Investment Banks (Sell-side), (ii) Central Banks and other Banks, (iii) Government Institutions, (iv) Universities/Research Houses, (v) Intergovernmental Organizations (IGOs) and (vi) Corporates/Real Estate/Professional Services.
Customer must obtain prior written approval from Macrobond and Factset to allow any other Designated User(s) which are not explicitly permitted in this section (g), including but not limited to (1) Asset Managers, (2) Hedge Funds, (3) Insurers, (4) Pension Funds, (5) Private Equity, (6) Sovereign Wealth Funds and (7) Wealth Managers.
Notwithstanding the aforementioned the following Designated User profiles are however also permitted to be Designated User(s): Strategists and Economists.
Derived Data Permissions and Restrictions:
(a) Designated User(s) may create Derived Data in the form of market analysis using Insubstantial Amounts of the Data for marketing, demonstrations and internal testing purposes only.
(b) Designated User(s) may generate Derived Data using Insubstantial Amounts of the Data.
FTSE
All Customers shall only be permitted to view the Data internally. No other use of the Data shall be permitted. For the avoidance of doubt, it is not permitted to:
(a) copy, sell, license, distribute, transmit or duplicate the Data or any parts thereof in any form or by any means to any third party or to any person in your organization not expressly licensed;
(b) derive, recalculate, combine with other data or otherwise modify the Data, and/or distribute such derived, recalculated, combined or modified Data to any third party;
(c) remove any proprietary notice accompanying the FTSE Data;
(d) the Customer shall not use the Data for the purpose of:
(i) creating and/or operating (whether by itself or by any third party) any financial product, index or service which seeks to match the performance of or whose capital and/or income value is related to the Data or any part thereof;
(ii) creating and/or operating (whether by itself or by any third party) any financial product, index or service the performance of which is linked to the performance of a third party’s product, index or service which, in turn, seeks to match the performance of or whose capital and/or income value is related to the Data or any part thereof (and whether or not such third party is licensed by the Licensor to do so); or
(iii) generally exploiting the Data in a manner designed to benefit the Customer or any third party (including the creation of any product or service).
(e) the Customer shall not make the Data available on any website or in an application, or to the public via the internet or otherwise.
FTSE Russell
Customer is required to enter into a separate license agreement (which may be subject to additional charges) with The Frank Russell Company (“Russell”) in order to access and/or use indices, index values, data or other information relating to or derived from any Russell index (“Data”) via the Macrobond Product(s). Unless expressly permitted otherwise under Customer’s written agreement with Russell, Customer may use the Data solely, for its own internal business purposes (if Customer is a business) or individual purposes (if Customer is an individual), and shall not, and shall not permit any third party to, do any of the following:
(a) copy, sell, license, distribute, transmit or duplicate the Data (or any part thereof) to any third party or to any person or other entity in Customer’s organization (unless such entity is expressly licensed under Customer’s agreement with Macrobond to receive such Data) in any form or by any means;
(b) derive or create derivative works of, recalculate, combine with other data, or otherwise modify, the Data (except that you may reprocess Data and perform calculations using the Data for your own internal business use subject to the other restrictions herein), and/or distribute such derived, recalculated, combined or modified Data to any third party;
(c) remove any copyright or other proprietary notice accompanying or incorporated into the Data;
(d) use the Data for the purpose of:
(i) creating and/or operating (whether for your own purposes or on behalf of any third party) any financial product, index, or service which seeks to match the performance of or whose capital and/or income value is related to the Data or any part thereof;
(ii) creating and/or operating (whether for your own purposes or on behalf of any third party) any financial product, index or service the performance of which is linked to the performance of a third party’s product, index or service which, in turn, seeks to match the performance of or whose capital and/or income value is related to the Data or any part thereof (and whether or not such third party is licensed by Russell to do so); or
(iii) generally exploit the Data in a manner designed to benefit you or any third party (including the creation of any additional service).
(e) make the Data available on any website or in an application, or to the public via the internet;
(f) use the index trade marks in a generic way or as part of Customer’s name or the name of any associated company;
(g) use the Data or index trademarks:
(i) in a way that might cause confusion as to the person responsible for preparing or disseminating the Data;
(ii) for any unlawful or illegal purpose in any jurisdiction; or
(iii) for or in connection with any contracts for difference service, spread betting service or any other purpose related to betting or gaming;
(h) use the Data on behalf of, or for the benefit of, anyone else; or
(i) use the Data in any way or for any purpose that would require a separate license from Russell or a third-party information provider. Customer acknowledges that Russell and/or any relevant third party information providers are the owners of the intellectual property rights in the Data, and that the Data is provided subject to the terms of your agreement with Macrobond. Customer hereby agrees to comply with any terms and conditions governing the use of any third party website or content accessed through the Product.
GFI Group
Customer has no right to and shall not: use the Data at any location other than Customer's own office or for any person (other than Designated Users) not specifically licensed for such use whether through physical transfer of hard copies of the Data, general display, electronic access through a local or wide area network of any description, or by any other means whatsoever without limitation.
Green Street Advisors
Any copying or dissemination of the Data to the public is strictly prohibited.
HFR Indices
Restrictions on usage and distribution. Customer’s use of the HFR Indices is solely limited to internal usage only without a direct license agreement with HFR. Contact HFR for more information. No redistribution by any means is permitted by the Customer or Customer’s group. Customer is strictly prohibited from any form of onward distribution of Hedge Fund Research Indices, up to and including any and all derivative works.
Additional Restrictions. Customer will not copy or manufacture the Index Data set or any portion thereof for any use prohibited under the Agreement, including Customer may not:
(i) translate, modify, adapt, enhance, decompile, disassemble or reverse engineer the Index Data set, except as to render the Index Data set in a format compatible with the Macrobond Software and to the extent permitted under applicable law despite this restriction;
(ii) use the Index Data set to create an index or populate any other commercial database or index data set;
(iii) use the Index Data set in the operation of its own data or index business;
(iv) use the Index Data set, resultant data and/or HFR trademarks, including HFR Index names, ticker symbols or graphically representative HFR Index performance in any manner in association with products which are created as investable index products.
ICAP plc
Usage Rights. Customer may:
(a) Store the Data on its own internal systems;
(b) Use the Data within the Customers licensed internal server-based software solely for the purpose of creating Derived Data;
(c) Allow Designated Users to create Derived Data from the Data, by calculating and/or manipulating the Data and/or otherwise altering the Data; provided that such Derived Data is created in such a way that it is not possible for:
(i) any third party to reverse engineer the Data or any part of it from the Derived Data;
(ii) the Derived Data to be used as a substitute or replacement for any Data; and
(d) Provide such Derived Data created in accordance with this Customer’s Llcense rightsto its own employees for use within the Customer’s own internal business function, location, or application to which this license applies.
ICE BofAML
ICE BofAML herby grants to Customer a limited, non-exclusive license to distribute and/or communicate the Indices to Customers client’s who have been pre-approved solely for the recipient's internal business use. Customer represents, warrants and covenants to ICE BofAML that neither Customer nor any of the recipients shall redistribute and/or disseminate the Indices to any other third parties, without ICE BofAML's express written approval.
Intercontinental Exchange (ICE)
Any Customer using Delayed Benchmark Pricing Data or Delayed Pricing Data in accordance with the Public Display Agreement for use on a public website, electronic or printed report or television network must execute the Public Display Agreement and pay the fee that is detailed in that agreement.
J.P. Morgan
Customer will not, directly or indirectly:
(a) alter, remove or conceal any copyright, trademark or other proprietary notice or disclaimer regarding the Data;
(b) modify, copy, translate, recompile, decompile, disassemble, reverse engineer and/or make, distribute any other form of and/or any derived work from, the Data; and/or
(c) grant any rights in, permit, provide access to and/or otherwise distribute, whatsoever, the Data.
MSCI
Customer shall attribute the Data with the following:

This information is provided on an “as is” basis, and the user of this information assumes the entire risk of any use made of this information. Neither MSCI nor any third party involved in or related to the computing or compiling of the data makes any express or implied warranties, representations or guarantees concerning the MSCI index-related data, and in no event will MSCI or any third party have any liability for any direct, indirect, special, punitive, consequential or any other damages (including lost profits) relating to any use of this information.
S&P Global
Customer shall attribute the Data with the following:

S&P DISCLAIMS ANY AND ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE. In no event shall S&P be liable for any direct, indirect, special or consequential damages, costs, expenses, legal fees, or losses (including lost income or lost profit and opportunity costs) in connection with subscriber’s or others’ use of S&P data.
Software Provider Terms and Conditions
Bloomberg
All use of the Data (and Derived Data derived therefrom) provided or made available by Bloomberg or its affiliates to Customer, is governed by the terms and conditions set forth in the applicable Data Agreements between Bloomberg or its affiliates and Customer (“Bloomberg Agreement”). To the extent any terms and condition of the Agreement conflict with the terms and conditions of the Bloomberg Agreement, the applicable terms of the Bloomberg Agreement shall prevail.
Indicio
Customers use of the Indicio shall be subject to the following additional terms and conditions:
1.Product. Indicio Services.
Indicio Services Specification: Indicio forecasting platform automates the application and evaluation of macro-economic forecasting models, identification of leading indicators and scenario analysis.
Supported browsers: Chrome, Edge.
Hardware requirement: Resolution: 1024px or higher, RAM: 8GB or higher, Processor: 2 GHz or faster.
2.Terms
2.1 All references to Product and Data in the Agreement are also applicable to the INDICIO services as described on https://www.indicio.com.
2.2 The Customer shall upon any display of the Customer Output credit INDICIO, wherever it’s technically and commercially feasible. However, the Customer shall not use INDICIO's trademarks and logos or the INDICIO services in any way without INDICIO’s written permission.
2.3 The Customer shall not upload any personal, copyright or security classified data into the INDICIO platform. INDICIO shall ensure that any Customer Data stored on the host systems is not accessible by third parties without the Customer’s prior consent.
2.4 Customer may use part of the INDICIO services, which is under development or testing and that is marked “BETA” or with similar designation (“Beta Services”), in a manner consistent with the terms and conditions of the Agreement, and INDICIO disclaims all warranties, representations, and liabilities for the Beta Services and INDICIO shall not be liable for damages of any kind related to Customer’s or Designated User’s use of such Beta Services.
2.5 INDICIO may at any time without prior notice, implement updates and upgrades, including but not limited to changes that affect the design, technical specifications, and function of the INDICIO services. INDICIO agrees that no such measures shall be performed between 08.00 am CET and 05.00 pm CET. Notwithstanding the foregoing, INDICIO may take immediate measures for resolving security issues or critical bugs if reasonably considered urgent.
2.6 All ownership rights to the usage data and/or Feedback, including to any intellectual property rights therein, generated through the Customer’s use of the INDICIO services during the term of the Agreement are and shall remain vested in INDICIO. INDICIO may thus use, store, copy, and analyse the anonymized usage data and/or Feedback.
2.7 The Customer acknowledges that all intellectual property rights in and to the INDICIO services are the property of INDICIO or its licensors (including Data Providers), as applicable. Nothing in the Agreement shall give the Customer any right, title or interest in or to the INDICIO services other than the right to use the INDICIO services as set out in the Agreement.
2.8 Customer shall at all times remain liable for the Authorized Users’ use and any unauthorized use of the INDICIO Services. INDICIO shall have no liability for any loss or damage arising from Customer’s use of the INDICIO Services, including any use, operation or combination of the INDICIO Services with software, services, content, data, or materials not provided by INDICIO.
2.9. Use Restrictions. The Customer may access and use the INDICIO Services solely for its internal business operations and not for the benefit, commercial or otherwise, of any other customer, supplier, or third party. The Customer shall not, and shall not permit any third party to (a) reverse engineer, disassemble, or try to discover the underlying code or structure of the INDICIO Services; (b) modify or create derivative works from the Services; or (c) use the INDICIO Services, and/or the Services output to develop, build, offer, or operate any similar product or service.
2.10. The Customer represents and warrants that it has all necessary rights, licenses, and permissions to use and input any data into the INDICIO Services, including data sourced from third-party providers. The Customer further warrants that it will comply with all applicable terms governing the use of such third-party data. INDICIO shall have no liability arising from the breach of such third-party agreement.
2.11. Termination Right. INDICIO may terminate its provision of INDICIO Services with immediate effect by providing written notice to the Customer if INDICIO ceases to have the legal right, license, or ability to use any third-party services or data that are essential for the provision of the INDICIO Services under the Agreement, and such cessation materially affects INDICIO’s ability to perform its obligations. In the event of termination under this clause 2.11, the Customer will be entitled to a pro-rate refund of any prepaid fees for the INDICIO Services not rendered as of the termination date.
